Terms of Business

Medical Imaging Partnership Limited (MIP) and Prime Health Diagnostics Limited (PHD) are affiliated companies in the same group ownership.  The services provided to you under these terms and conditions (“Services”) will be provided by either MIP or PHD depending on the location where you choose to access the Service, and for the purpose of these Terms and Conditions MIP and PHD are together referred to as the Company or Companies.

Please read these terms and conditions carefully and consider any additional information provided in the links below which all forms part of the contract between you and the Company.  For you to get the most out of our Services it is important that you have considered and acted upon any recommendations included in these terms.

“Appointment” means the date, time and location where your Investigation will be carried out by the Company.

‘Investigation means any scan or other investigation to be carried out by the Company in accordance with these terms.

‘You’ means the patient using the Company’s services.

‘We’ means the Company.

Our Commitment to you

  1. Acceptance of your booking will take place once payment is received. On acceptance of your booking a contract for the Investigation will be formed between us.
  2. Depending on the nature of your Investigation you may be required to complete additional questionnaires which will be provided to you prior to your Appointment.
  3. We will supply our Services on the date of your Appointment unless we have notified you in advance of a requirement to cancel your appointment for reasons beyond our control. If we cancel your Appointment for reasons beyond our control, we will liaise with you to agree a new Appointment at no additional cost or alternatively you may elect not to take a new Appointment at which point we will refund to you the fees paid in respect of the appointment prior to its cancellation.
  4. Your Investigation will be carried out by qualified professionals using reasonable skill and care.
  5. The provisions of the Cancellation Policy below apply to any cancellation by you of the Appointment.

Referral

We will only accept your booking on the basis that you have been referred by a clinician or, in the case of self-referral, meet our eligibility and safe scanning criteria. You understand that the Investigation may result in a diagnosis of cancer or another serious condition and we therefore require you to notify us of the identity of your GP or a qualified clinician having responsibility for your care, at the time of booking.  This is so that we can ensure that you have the opportunity to discuss the results with a qualified medical practitioner in order to make treatment decisions.  It is important that you arrange to follow up the results of your Investigation with a qualified medical practitioner.

Liability

It is not always possible to provide complete accuracy in the performance of an Investigation. This is the case in respect of screening services where 100% accuracy is not always achievable in all cases.  Not all cancers can be detected using the Investigation.  There is an occasional risk of false positives or false negatives. 

We seek to minimize the risk of inaccuracy where possible by undertaking safety questions with you at the time of booking, by regularly calibrating our equipment and operating it in accordance with manufacturers’ instructions and by auditing a percentage of our Investigation Reports in line with accepted good practice for quality assurance purposes. 

Should your MRI scan fail to provide a clear result and be classified as inconclusive, our specialist radiologist may recommend that you be recalled for an additional MRI scan using contrast (dye) injection. This allows us to gain a greater level of detail of your prostate. There is no extra charge for this. Should you decline this additional scan, we shall be under no liability whatsoever for any direct or indirect consequences this may have on your further diagnosis and resulting treatment. If you decide to decline this additional scan we recommend that you discuss that decision with your qualified medical practitioner.

Our highly skilled and qualified radiologists comply with all statutory and regulatory requirements and undertake regular training.  Unless we have been negligent in the performance of the Investigation we shall not be liable for inaccurate results.  

We are not responsible for inaccurate results caused by incorrect, incomplete or false answers to our standard screening questionnaires, medical history questionnaires or any other documents provided to us by you for the purpose of the Investigation.

Nothing in these terms shall exclude our liability for death or personal injury caused by our negligence nor any other liability which is not legally permissible to exclude.  We shall be under no liability whatsoever for any indirect or consequential loss or damage and our total liability to you in respect of all the other terms shall be limited to the amount of fees paid by you for the Investigation.  Except as otherwise set out in these terms all warranties conditions and other terms implied by statute or common law are to the extent permitted by law, excluded.

Consent

You hereby consent to the investigation. assessment and/or treatment recommended and performed by the clinicians at the Company in accordance with its governing bodies’ professional guidelines. You understand that before any investigation assessment or treatment is carried out the clinician will provide a full explanation of the purpose and any risks associated with that investigation assessment or treatment. You understand that should you wish to decline any form of investigation, assessment or treatment you can do so at any stage and that you should inform the clinician of your wishes at the time. By ticking the acceptance box you consent that you are in agreement with these conditions.

Financial Agreement:

You agree to pay for any services provided by the Company in accordance with the Company’s terms of business. You understand that you will be asked to settle your fee at the time of booking your investigation. You also understand that if your payment for your scan has not been received by the Company you will not be permitted to receive your scan.

Cancellation Policy

Clients who book Appointments at the Company are required to give 24 hours advance notice if they are unable to attend, otherwise they will be charged in full for the unattended appointment. This policy is deemed necessary to avoid denying appointments to clients who may be on a waiting list and causing revenue loss to the Company.

Data Processing and Sharing Consent

Whilst carrying out any investigations, assessments or treatments, the Company will need to record and potentially share with other healthcare clinicians or organisations certain information about you, from which you may be personally identified. Your acceptance of this agreement gives the Company consent to record and share that information and use it in accordance with the provisions of the EU General Data Protection Regulations 2018 (the “GDPR”).

You will find our privacy policy at https://medicalimaging.org.uk/privacy-policy/. Any personal information that you provide to us will be held in accordance with the terms of our privacy policy.

We will only process your personal data in accordance with our Privacy Policy and these terms and in accordance with the requirements of GDPR.  A Data Protection Officer is appointed for the Company in accordance with the requirements of GDPR and can be contacted at dean.putland@medicalimaging.org.uk.  You may withdraw your consent for us to process your personal data at any time by contacting the Data Protection Officer but this may affect our ability to complete your Investigation.

We also have a legal obligation to hold and make available as required your Medical Information in accordance with the NHS ‘records management codes of practice’ and minimum data retention guidelines which vary by patient type. We will only hold information about you which is relevant to the performing of investigations, assessments or treatments and the reports on their outcome. We will hold that information in confidence and will only share It with those involved in or those who may become involved in your treatment or care, for example the requesting Clinician, the Radiologist reporting a scan, your Therapist or GP. If you are being treated as a private patient, confidential information may be disclosed to the person or organisation (or agent of the person or organisation) who may be responsible for meeting your treatment expenses, if any (For example: an insurance company/solicitors etc).

We may use identifiable information for research, statistical and educational purposes or quality assurance and clinical audit. Any reports issued as a result of these activities will not contain any patient identifiable data. All information held will be retained (until destroyed) in accordance with the requirements of the GDPR.

The Company does not share data with any other provider of healthcare services or other interested parties for marketing purposes, nor does It share any information about clients with commercial companies.

It is possible for you to request a copy of the Information we hold about you at any time. Complaints

We aim to provide Investigations to the complete satisfaction of our patients but if you do have any issues with our Services you may complain to;  Governance Department, Medical Imaging Partnership,  Unit 7, The Pavilions Brighton Road, Pease Pottage, Crawley, RH11 9BJ Or email: governance@medicalimaging.org.uk.  A copy of our complaints policy can be found https://medicalimaging.org.uk/about/comments-complaints/ and the process described in that policy for the resolution of complaints applies to these terms.

General

These terms constitute the entire agreement between us in relation to our Services.

These terms and conditions are governed and construed in accordance with English Law and you and the Company hereby submit to the exclusive jurisdiction of the English courts in resolution of any dispute arising hereunder.
